I spent three weeks trying to bridge Reticulum onto HF so two people could pass a real message hundreds of miles with no cell tower, no Starlink, and nobody in the middle charging a toll. The radio is a Hermes Lite 2. The hard part isn’t only the physics — U.S. amateur rules also forbid hiding the meaning of a message on these bands, so whatever goes over the air has to be legal. This is an attempt to build an open-source internet we actually own, using the sky as the hop.

Et nyt udkast til AI-hjemmelsloven er i høring frem til 5. oktober. Det giver offentlige myndigheder hjemmel til at bruge AI som beslutningsstøtte, men ikke til automatiske afgørelser.

Da jeg læste det, blev jeg mindet om et citat, Jacob Haugaard gav fra Folketingets talerstol i 1995: "Min personlige opfattelse er, at jeg må stå over for sådan en flok halvuvederhæftige lystløgnere."

Jeg vil ikke kalde nogen lystløgnere. Men lovforslaget hænger slet ikke sammen i praksis.

Udfordringen her er, at sagsbehandleren ifølge forslaget skal tage reel stilling til det forslag, AI-systemet kommer med.

Men ministeriet skriver selv, at kravet til den menneskelige involvering ikke er fastlagt klart. Logning og dokumentation af afvigelser nævnes i den forbindelse som gode redskaber, men de er ikke et krav.

Det er simpelthen for dårligt. Al erfaring viser at myndigheder gør det, de bliver pålagt - og ikke mere end det.

Selvfølgelig ikke. De har også en økonomi, der skal hænge sammen, og tekniske kontroller er dyre både at implementere og drifte.

Lad os antage, at lovforslaget går igennem. Hvad sker der så, når en afgørelse bliver påklaget og behandlet et halvt år senere?

Hvis der ikke er krav om logning, hvordan dokumenterer myndigheden så, at sagsbehandleren ikke bare kopierede AI-systemets forslag?

Min helt store anke er, at forslaget ser stort på al erfaring fra arbejdet med GDPR og NIS2... og den praktiske konsekvens deraf er at både kommunerne og styrelserne efterlades uden at vide, hvad der egentlig kræves af dem. 2. Våbeneksport (F-35) Dansk deltagelse i F-35-program trods risiko for krigsforbrydelser. Våbenhandelstraktatens artikel 7: Forbyder eksport, hvis der er "overvejende risiko" for folkeretskrænkelser. Inkonsistent tolkning: Skift fra norsk/dansk linje (ingen afvejning) til britisk (sikkerhedsinteresser vejer tungere). Benlås-argument: "Vi har ikke råd til at overholde folkeretten".
3. Udvisning af kriminelle udlændinge Lovforslag om skærpede udvisningsregler (2026). EMRK artikel 8 (ret til familie- og privatliv) vs. samfundets sikkerhed. Politisk foregriben: Danmark antager, at EMD’s praksis vil ændre sig baseret på ikke-bindende erklæringer (fællesudtalelse, Chișinău-erklæringen). Problem: Udfordrer EMRK-systemets integritet.
4. Angrebet på Iran (februar 2026) USA/Israels angreb på Iran (krænkelse af magtanvendelsesforbud). Ingen retfærdiggørelse: Hverken humanitær intervention eller selvforsvar (artikel 51) var opfyldt. Tvetydighed: Løkke undgår at kalde det en krænkelse; forsvarsministeren kalder det en "klog beslutning".

Mønster: - Standhaftighed når danske interesser trues (Grønland). - Fleksibilitet når allierede (USA/Israel) eller sikkerhedsinteresser er involveret (Iran, våbeneksport). - Risiko: Undergraver Danmarks troværdighed og reducerer folkeretten til politisk opportunisme.


🎯 Forfatterens løsningsforslag

  1. Fokus på retsdogmatik:

    • Folkeretsjurister må skærpe metoden til at fastslå gældende ret.
    • Kvalitet i juridisk analyse > kortvarig effektivitet.
    • Eksempel: ICJ’s argumentationsstruktur er forblevet stabil, på trods af teoretiske udfordringer.
  2. Kritik af dansk debat:

    • Offentlig argumentation mangler ofte juridisk præcision.
    • Domme og lovgivning bør baseres på objektive, konsistente tolkninger – ikke politiske hensyn.
  3. Universiteters rolle:

    • Formidle retsdogmatisk metode til studerende, embedsmænd og politikere.
    • Fastholde skellet mellem ret og ikkeret, selv under pres.
  4. Langtidsperspektiv:

    • Folkerettens modstandskraft afhænger af metodisk disciplin, ikke af dens umiddelbare effektivitet.

💡 Konklusion

Folkeretten er ikke ubrugelig, men dens troværdighed afhænger af, at vi: ✅ Præcist definerer, hvad der er gældende ret. ✅ Anvender konsistente metoder i juridisk analyse. ✅ Undgår politisk farvning af folkeretlige spørgsmål. ✅ Insisterer på kvalitet – også når det er ubelejligt.

Revolution er ikke nødvendig; reform og metodisk stramning er.

Age verification is having a moment in Brussels. But before we start checking who’s old enough to scroll, we should ask why scrolling is so hard to stop. Our member D3 has brought the first class-action lawsuits of their kind in the EU against Facebook, Instagram, TikTok and YouTube over what it describes as “addictive design”.

The cases challenge features such as infinite scrolling, autoplay, persistent notifications, personalised algorithmic recommendations and gamification, all designed to keep us engaged for longer

And yes, children and young people may be particularly vulnerable to these features, but the attention economy has all of us in its sights.

The EU must seize the opportunity to tackle the business models and design practices that exploit vulnerabilities and manipulate behaviour, rather than simply asking users, parents or children to navigate around them.

Age-gating an unsafe environment doesn’t make the environment safe. With the #DFA, EU lawmakers have an opportunity to build a digital space designed not to exploit anyone’s attention in the first place.

There are already rules on age limits and the protection of children online. The problem is not a lack of rules, but a lack of enforcement.

ICCL makes another important point: it argues that Ireland, as EU Council President, should stay out of EU digital policy matters during its presidency due to a conflict of interest.

The biggest problem is a business model where users pay with their personal data, attention and behavioural data. This conflicts with the principles of the GDPR.

Age verification can give tech companies even more data, even though they can already estimate age from the many data points collected today.

The US shows that tech giants can face tough enforcement. Meta has reached a multibillion-dollar settlement with US states over allegations concerning the harmful effects of children and young people's use of Meta's platforms. At the same time, the US has required TikTok's US data to be handled under American control, strengthening US data sovereignty.

China has chosen a different model. TikTok does not exist as TikTok in the Chinese market and Meta's services are blocked.

The EU is losing more and more digital and data sovereignty. The six horsemen of the digital apocalypse are already here!

Age verification only treats the symptom but it doesn't tackle the underlying cause. Addictive platform design, endless scrolling and personalised feeds make social media apps so hard to put down. It affects both children and adults. High time we do something about the cause, not the effect.
